Senate Finance Committee Reworks Health Care Reform Bill

SUZANNE PRATT: One-sixth of the U.S. economy is getting a make-over today on Capitol Hill. The Senate Finance Committee has taken up an historic reform of the nation's health care system. And before the legislation was out of the starting gate, it was already being changed. Senator Max Baucus, the author of the bill has agreed to scale back the tax on so-called gold- plated health insurance policies. But as Darren Gersh reports, a key concern remains how much the average American will have to pay to buy coverage.

DARREN GERSH, NIGHTLY BUSINESS REPORT CORRESPONDENT: From the very beginning, the hard work of the Senate Finance Committee came down to balancing the cost of expanding health care coverage with affordability. Striking that balance is the job of committee Chairman Max Baucus.

SEN. MAX BAUCUS, FINANCE COMMITTEE CHAIRMAN: No one should go bankrupt because they get sick. This bill would fix that.

GERSH: Today, Baucus added billion over the next decade to help low-to-moderate income Americans buy health insurance. They'd buy it from the new exchanges the bill would create to organize the insurance market. The move was a clear nod in the direction of Maine's Olympia Snowe, the only Republican still on board with the effort.

SEN. OLYMPIA SNOWE (R) MAINE: There remains major outstanding issues that must be resolved to ensure that everyone, whether they're in an exchange or getting employer-provided coverage is able to afford a plan.

GERSH: The subsidies in the Senate Finance bill would help families earning up to ,000 buy coverage. But health care analyst Rick Weissenstein says some lawmakers think the help isn't enough.

RICK WEISSENSTEIN, HEALTH CARE ANALYST, CONCEPT CAPITAL: I think the members are concerned that, for a family or four making ,000 in most places in the country, you're largely paycheck to paycheck and the idea that you might have however much insurance for a family of four would cost 0, 0, 0 a month, I think is really questionable.

GERSH: For Snowe's fellow Republicans, like Arizona's Jon Kyle, the Baucus bill is unaffordable because it raises taxes, putting at risk those who now have private insurance.

Fly Fishing Oregon's Fall River

You may not have seen an uglier imitation of a natural bug in your life, and hopefully you never will. In fact, the world's leading entomologist would've had a hard time determining what I was trying to duplicate with this fly. It was by far the sloppiest attempt at the traditional elk hair caddis pattern to date. Purely an exercise in beginning fly tying, and one of the first to come off of my assembly line known as a vice.

It was a combination of ego, sentimentality and hopeful romantic fantasy that allowed it into my fly box. Wouldn't it be something if it worked and I actually landed a fish with my first attempt at fly tying? A lost cause you would think while looking at it. But, it felt good just have it sit in my fly box next to those store-bought, apiece, professionally tied flies.

I knew the trout of Oregon's Fall River were smarter than to accept my fly. They've seen, and passed on, the most meticulous artificial creations (very professionally tied ones). No matter, in time there I am, fly fishing Oregon's Fall River, and the only one on the water.

Although some of the gin-clear river is lined with private property, there are plenty of entry points along its banks with easy wading. Fallen trees and grasses provide cover for `bows, brooks and browns. The river, at times only 20 feet across and at others 50, stretches for 8 miles along Route 42 through the Deschutes National Forest just South-west of Bend. It's fly fishing only and when you go be sure to visit the hatchery, which is open to the public.

Waste deep at a U-shaped section of water I open my fly box to see what I have to choose from. And there it was, my Frankenstein Fly. The image reminded me of those children's magazines you find in Doctor's offices. The ones that challenge you to find the hidden mistakes in the cartoon. Well in the case of my fly box, the mistake wasn't too well hidden or too hard to pick out.

You put the leader through the eye of the hook. That's the first step. I couldn't. The eye was blocked by cement. The clear, glue-like stuff that you use to hold all the thread, feathers and so forth in place. I poked at the loop with a sharp object. Eye clear, knot tied, and I'm castin'! A few false casts later and my elk-haired monster is sitting on prime trout real estate.

It naturally drifts the run I'm working, imitating nothing, but giving the trout in the area front row seats at the equivalent of amateur night at the Improv. Oh what a laugh I was giving those `bows. But no matter, I'm fly fishing Oregon's Fall River, and I'm the only one on the water.

Twenty minutes of working the same run, with the fly that even the most desperate of Mayflies would pass on at 2:00 in the morning at the local bug bar, and all I've done is practiced my casting technique. My Frankenstein Fly isn't fooling anything. Now I realize what a great idea it was to leave my camera back in the truck. I sure didn't need it to weigh down one side of my fishing vest for no reason.

It's getting late in the day, and this is the last stretch of water I thought I would try before heading home. I landed a nice 17 rainbow (on a real imitation fly) earlier this morning up-stream, counted 6 deer, and had a huge bald eagle fly over. So no matter what happens in this last section of water, I've already had a storybook day.

My state of mind has turned now from hopeful romantic to one of end-of-the-day game playing. Just how close could I get my bootleg caddis fly to that fallen tree laying over there, and still pull it off the water before it snags the log? One foot, not bad I thought for the amount of line I have out. A few drifts later and I have this fly jumping off the water within six inches of the fallen tree. Not casting champion material, but I'm fly fishing Oregon's Fall River, and I'm the only one on the water.

Turns out I couldn't get the fly any closer than six inches, I've snagged that damn tree! No worries I thought, it was an ugly fly anyway. But wait, the tree is moving with my redheaded stepchild caddis fly in its mouth. My 4-weight G. Loomis rod is bent and my orange colored floating line is zipping through the water as if ...FISH ON, and I fear no fish!

This couldn't be happening, this shouldn't be happening I thought to myself. As I see flashes of silver-lightening streaking through the water, I realize the fallen tree was providing cover for a monster rainbow. But what about my Frankenstein Fly? Do trout get glaucoma?

Run and rest, give and take, point and counterpoint. I'm engaged in an ageless dance with what must be the hungriest candidate for laser eye surgery in all of Central Oregon.

At the bank, I set the defeated 19 rainbow down on green summer grass with my Chernobyl-mutated elk hair caddis still very much in the corner of its mouth. A horribly tied fly, but a very sharp hook. Boy what a classic picture this would've made. I even have a spot on the wall in my office for such a picture. I sure am glad I didn't want that camera uncomfortably weighing down one side of my fishing vest. Better to release the 19' elder I thought, than to kidnap it all the way back to the truck against its will just for the sake of a picture.

I gently back-out my barbless masterpiece, and without much convincing the beautiful but embarrassed rainbow decides to head back to its hole. And with no fish, and not even picture to prove it, I decide to call it a day as well. But not before whispering to myself I'm fly fishing Oregon's Fall River, and I'm the only one on the water.

To build your list, add a feature on your group's website for collecting the e-mail addresses of supporters. You can also collect e-mail addresses from everyone who makes a purchase or supports you during your regular fundraisers. With a large e-mail list, you will build a strong channel for getting information out whenever your group has new news (or a new fundraiser).



* Set realistic goals--and accept nothing less. No matter how small your organization is, fundraising is all about numbers. If you know exactly how much money you need to raise, you can determine how much money each group member should be responsible for generating. If your fundraiser is something as simple as a bake sale, simply do the math: how many items at 50 cents each does each person have to bake in order to hit their goal? This kind of logic can be used across any kind of fundraiser. Also, when setting member-specific goals, take a tip from the world of sales and secretly inflate everyone's quota by 10% to 20%. That way, even if 10% to 20% of your members fail to meet their quotas, you will still hit your overall fundraising goal.

Yes, they may contribute just a few dollars today, but if you add up how much they contribute in their lifetime, the numbers can be staggering. This idea of lifetime value teaches a valuable lesson: losing a supporter is more expensive than you think. When someone decides to stop supporting your cause, you are losing income for every future fundraiser you hold. As a result, you should take special care not to alienate, insult, or otherwise offend anyone in your supporter base. This can happen if your fundraiser sells low-quality products, overcharges for items, or pressures donors too highly. Talk to your supporters and see what kinds of fundraisers appeal to them the most. Usually, a fairly small sample size can be enough to get an idea of what fundraising strategy will be best received by your supporter base.

Vacuum Truck Safety and Oil Field Work!

Among other tasks, one of the most common ones for a vacuum truck takes place in an oil field. This equipment is an indispensable tool for collecting the by-products of oil and gas exploration, such as basic sediment and water. Unlike other liquids, waste that is collected from oil and gas exploration is potentially flammable, so even though the equipment is designed to perform this job, there are necessary precautions that must be implemented in order to avoid this type of serious accident.

Risks Involved

While sediment and water collected from gas and oil production wells may seem like just another mix of waste water, they could contain flammable hydrocarbons that can combust at a high rate and therefore carry a great deal of risk and danger. An analysis conducted by the Chemical Safety and Hazard Investigation Board (CSB) on nine wells showed that eight out of the nine tested had flashpoints below 30 F. According to the Occupational Safety and Health Administration (OSHA), any liquids that have a flashpoint of 100 F are considered to be flammable.

The study regarding the potential risk of loading and unloading the sediments and water waste generated by gas and oil wells began when an accident occurred at an oilfield waste disposal complex on January 13, 2003, in Rosharon, Texas, just outside of Houston. A couple of vacuum trucks were in the process of unloading a mixture of sediment and water that had been collected from oil field production wells. The two trucks were parked 16 feet from each other and the drivers were given instructions to unload and rinse out the vehicles. After this was done, the two drivers proceeded to the driver's shed for their papers to be processed. After a few minutes, a huge explosion occurred inside the waste disposal facility killing three people and causing severe burns to three others. The explosion also caused a great deal of damage to the facility.

An investigation conducted by the CSB and OSHA revealed that the condensation inside the tanks caused the explosion and the source of ignition was the truck engines, which were still running. These findings were backed by eye witnesses of the incident, as well as other evidence that was found at the scene.

What Went Wrong

Many factors contributed to this explosion occurring. The shipper failed to identify the flammability of the waste being disposed. The transportation company did not request the Material Safety Data Sheet (MSDS), which could have provided information about the hazards of the material being transported. The waste collection facility also did not have an effective system of determining the hazards of handling and unloading water and sediments from oil and gas wells.

How to Be Safe

Before handling flammable waste liquids including basic sediment and water, an operator must first undergo training for: hazard communication; flammable and combustible liquids; hazardous waste operations and emergency responses; air contaminants; and the proper classification and manifestation of flammable liquids. Below is a list of other precautions the drivers could have taken to save the lives of those affected by the blast.


* Request MSDS - Operators must always request an MSDS, and refer to it to determine the hazards associated with the material before transporting it.

* Be Aware of Hazards - Operators should be aware of any potential source of ignition, including the engine.

* Don't Mix Liquids - Different types of liquids should not be mixed to avoid any possible reaction.

* Test Atmosphere - Atmospheric testing should be done on-site to determine if any hydrocarbon concentration has reached the flammable range.

* Spark Control - Bonding and grounding should be implemented to eliminate any potential source of sparks.

Every vacuum truck is designed to be a safe means of transporting various types of waste material, including those that are hazardous and flammable such as those found in oil field work. Next review whether the retail space you are considering is complementary to nearby retail establishments. For example, it would not be appropriate to put a liquor store adjacent to a school for troubled children. However, a dry cleaners, nail salon, office supply store and dollar store might all fit well in their neighborhood shopping center anchored by a major grocery chain.

Complementary Stores

Grocery stores, drugstores and gas stations tend to be complementary. In some cases, they are all provided by one retailer. For example, many of the Sam's Club or super Wal-Mart's have groceries, a drugstore and sell gasoline. In addition, there has been a growing trend for grocery stores to sell gasoline as a loss leader. Their objective is not to make money selling gasoline. Their objective is to increase the number of trips customers make to the store to buy groceries.
Category Killers

In some cases, "category killers" cluster in a power center. (A category killer is a retailer who stocks every conceivable item relative to a category. Office Depot is a category killer for office supplies. Petco is a category killer for pet supplies.) Having four to six category killers in one cluster is referred to as a power center.

Will the Landlord Pay?

The landlord is usually willing to fund tenant improvement expenditures provided he is confident the tenant has the financial capacity to pay rent for the term of the lease. If you're representing a national retailer with a strong balance sheet, landlords will practically spend as much money as you request on tenant improvements. Of course, the cost of the tenant improvements will be built into the rental rate.
It's Up to You

If you're a start-up business with no track record and little capital, landlords will be cautious about expenditures for tenant improvements. They will likely want you to fund tenant improvements for your space. The benefit is your rental rate will be lower. However, you'll have to include the cost of preparing your space for occupancy in your initial capitalization.

Other issues related to tenant improvements include defining the work to be done, and who has financial responsibility for performing the work. If you're a national retailer, you might provide a landlord with a detailed set of plans for your space. It is then up to him to cost effectively provide the buildout you are requiring. If you're a smaller retailer, the landlord may provide a tenant improvement allowance, and require you to interface with contractors to have the work performed.

The cost of tenant improvements occasionally exceeds 0 per square foot for second-generation retail. It is generally much lower. Even if the landlord is willing to provide substantial funds for tenant improvements, be cautious about the scope of work for tenant improvements. The landlord's expenditure for tenant improvements is essentially a loan which will be repaid with your rent during the term of the lease.

If the space requires tenant improvements which require obtaining a building permit from the city, review whether you'll have to replace the restroom because of ADA. (ADA is the Americans with Disabilities Act). In most cases, changes to provide ADA compliance are not necessary if you not require a building permit. However, a consequence of obtaining a building permit is typically that the space must be revised to completely comply with ADA. Replacing the bathroom so it is ADA compliant can be expensive.

Different Types Of Futures Traders -- Hedgers

In Trading Futures, there are actually 4 types of futures traders active in the Futures Market. Each of these brings liquidity to the Market place needed for smaller investors to make a profit. You will see these 4 types of traders active at the largest US futures exchanges, the Chicago Mercantile Exchange (CME) and the New York Mercantile Exchange (NYMEX). If you are a futures trader, chances are, you will be one of the following...Hedgers, Speculators, Arbitrageurs and Spreaders. In this article we'll start with the first, hedgers.

What is a Hedger? Hedgers primarily deal with the commodities side of Futures Trading. You can be either a buyer or seller of Futures contracts and still be a Hedger. The whole idea behind hedging is to mitigate risk. There are those who buy Futures, for example, manufacturers who buy commodities or airlines who buy gas.

Lets look at a prime example of hedging Futures.

Take a bread manufacturer. When a bread manufacturer knows that he will be making a purchase in the future for wheat, he takes a long position (buys) futures contracts to hedge his position. Say the bread manufacturer wants to sell 1,000 loaves of bread weekly. He knows how much wheat he needs over the next year. He knows the current market price of wheat and wants to mitigate his risk, or hedge, so he works out a futures contract with a wheat grower to buy so many bushels of wheat at the current market price to be delivered over the next year. That way, should the price of wheat go up at any time, he has covered his bases by locking in his price ahead of time. What would happen if there were a tornado, or a flood and wheat became scarce, the price would skyrocket. So this way he controls the price of wheat and knows exactly what price to sell his loaves of bread for in order to make a profit.

Lets look at the other side for a moment. We know why someone would buy futures contracts to mitigate risk. Why would someone take the other side and sell the contracts?

If a farmer knows that he will be selling his wheat at harvest time, he would take a short position (sell) futures contracts to mitigate his risk. He knows what the current market price is. If he arranges a contract at the current price for a future delivery (namely after harvest), he is guaranteed the current price. Say that come harvest time, the price drops because there is an abundance of wheat. By arranging the price ahead of time, he has already locked in his sale. He knows how many bushels he will reap, what his profit is, etc.

There are a multitude of contracts that can be hedged. Certainly the commodities, wheat, rice, corn, soy, etc. There is also silver and gold. A dental lab, for instance, buys a futures contract in silver and gold, knowing they use the product for fillings. Airlines buy gasoline / diesel futures contracts years in advance for future delivery when the price of crude is low. Name any commodity and you will find hedgers ready to buy and sell well in advance of their delivery date.

Understand, there is risk attached for both buyers and sellers in any futures deal. Buyers risk that although they negotiate at the current price, by the time delivery occurs, the price could be much lower and they could have bought the commodities for cheaper. Sellers risk that although they negotiate at the current price, by the time delivery comes, the price could be much higher and they could have sold the commodities for greater profit. Futures trading is all about woulda coulda shoulda, the fish that got away. You may never get the highest price nor the lowest price. So long as you make a profit, that's all that really matters.

Service Tax On Equipment Leasing And Hire-purchase

This article makes a comprehensive analysis of the decision of the High Court in Kerala Non-banking Finance Companies Welfare Association v. Union of India [2009] 20 STT 1, wherein a recent issue as to : whether charging of service tax on banking and other financial services which include equipment leasing and hire-purchase, is unconstitutional, has been considered.

1-Vide section 137 of the Finance Act, 2001 service tax is introduced on Banking and other financial services' which include equipment leasing and hire-purchase'. The impugned provisions providing for service tax on Equipment leasing and hire-purchase transactions' are introduced by amending the Finance Act, 1994. The relevant definition of Banking and other financial services' is contained in clause (12) of section 65 of the Finance Act, 1994. Along with the introduction of the definition of Banking and other financial services', the charging section, namely, section 66 of the Finance Act, 1994 is also amended to cover tax on value of taxable services referred to in sub-clause (zm) of section 65(105). The question as to whether charging of service tax on Banking and other financial services', which include equipment leasing and hire-purchase, is unconstitutional, arose for consideration of the Kerala High Court in the case of Kerala Non-Banking Finance Companies Welfare Association v. Union of India [2009] 20 STT 1.

2 - The petitioner No. 1, an association of non-banking financial companies, which was covered under the definition of Banking and other financial services', and its two members, viz., petitioner Nos. 2 and 3 had filed a writ petition challenging the constitutional validity of the impugned provisions of section 137.

3 - These are discussed as under :

(a)- The Parliament has no authority to legislate on hire-purchase and leasing transactions which are subjects left for levy of sales tax by the States under entry 54 of List II of the Seventh Schedule to the Constitution of India.

(b)- After the 46th Amendment to the Constitution introducing clauses (29A)(c) and (d) to article 366, States are authorised to provide for sales tax among other things on hire-purchase and leasing transactions.

(c)- As a follow-up measure, all the States including the State of Kerala introduced provisions in the respective Sales Tax Acts authorising levy of sales tax on hire-purchase and leasing transactions.

(d)- Impugned provisions for levy of service tax on hire-purchase and leasing transactions are discriminatory and violative of articles 14 and 19(1)(g) of the Constitution.

4 - These are as follows :

(a)- Even though service tax is payable on the value of taxable service pertaining to leasing and hire-purchase transactions, the Government of India had vide Notification No. 4/2006-ST, dated March 1, 2006 granted exemption on 90 per cent representing interest income earned by the service provider.

(b)- The Supreme Court had upheld the legislative competence of the Parliament to levy service tax under the residuary entry 97 to List I of the Seventh Schedule in the decisions in Tamil Nadu Kalyana Mandapam Association v. Union of India [2006] 4 STT 308, C.K. Jidheesh v. Union of India [2005] 2 STT 242 and Gujarat Ambuja Cements Ltd. v. Union of India [2005] 1 STT 41 and thereafter, through constitutional amendments entry 92C to List I of the Seventh Schedule and article 268A are introduced expressly giving authority to the Parliament to legislate on service tax.

(c)- The validity of legislation and the grievances of the petitioners should be considered with reference to the aforesaid Notification No. 4/2006-ST, dated March 1, 2006, by which rigour of the levy was neutralized by granting exemption on 90 per cent of the charges received in the hire-purchase and leasing transactions, thereby completely excluding interest on loans from service tax.

5 - It is well-settled that the Constitution by virtue of the provisions contained in article 366(29A) authorises, levy of sales tax on hire-purchase transactions and on leasing of goods and based on the same there is State legislation authorising it.

6 - The legislation applies to all engaged in banking and other financial services and is not confined to members of the first petitioner. In fact, banking companies in the public Sector are also liable to pay service tax on financial leasing service including equipment leasing and hire-purchase . Since the petitioners had not established the parties engaged in the same business who were left out and how they were discriminated, the contention was to be rejected. Similarly provisions of service tax do not take away or create any unreasonable restriction on the fundamental rights of the members of the first petitioner including petitioner Nos. 2 and 3 to carry on business. Therefore, the allegation of violation of article 19(1)(g) also, did not merit consideration.

7 -There is no conflict between the levy of sales tax on the sale or deemed sale of vehicle under the hire-purchase agreement and the service tax payable on services rendered by the financier under the hire-purchase agreement. The provisions contained in article 366(29A) of the Constitution authorising levy of sales tax on the supply of goods under the hire-purchase agreement does not stand in the way of the Parliament levying service tax on taxable service charges received in respect of hire-purchase transactions by the financiers.

It is obvious that levy of sales tax is possible on sale of goods involved in the transactions while service tax can be levied on the service charges received in the transactions. Further, the provisions pertaining to levy of service tax on hire-purchase or lease transactions are not in any way different from the service tax authorised for the large number of transactions under the Finance Act, 1994, the constitutional validity of which is upheld by the Supreme Court. Since incidence of service tax is not on sale of goods or deemed sale of goods pertaining to leasing and hire-purchase transactions covered by clauses (c) and (d) of article 366(29A), the Parliament has authority to authorise levy of service tax on banking and other financial services including equipment leasing and hire-purchase.
